A person must claim to have been a victim of two acts of violence or stalking committed by another, in order to file a restraining order petition for Repeat Violence. At least one of those incidents must have occurred within the last six (6) months. The person filing the petition need not show that the relationship is "romantic" or "domestic." Thus, the motion can be filed by neighbors, co-workers, or former friends.

Under Florida Statute Section 784.046(1)b) and (2)(a), the respondent must have committed two acts of violence or stalking on two separate occasions, one of which must have occurred within the last 6 months. These types of restraining orders are the most prone to abuse and the most likely to be overturned on appeal.
